The
IACP has stated, "except for homicide, rape is
the most serious violation of a person's body because it deprives
the victim of both physical and emotional privacy and autonomy"
(IACP-International Association of Chiefs of Police, 1999
- ref: aic.gov.au)
Acquaintance
rape is a sexual assault against the will of a woman, a criminal
offence in the eyes of law. It
is difficult to define acquaintance rape or "date rape"
because of the indistinct ("gray area or hidden crime")
offence. "Date rape" occurs when the victim is socially
with the rapist and the sexual act is unwanted and uninvited.
There is no evidence of violence to cause bodily injury compared
to "real rape" which is force violence or sexual
assault. Sexual intercourse, oral sex, anal sex or other sexual
contact with force or threat of force is rape.
Pornography and media has influenced
that women like violence or aggressive sex. This issue is
a major problem in our society as men think that it is acceptable
to use sexual force. A rape is a rape when sexual intercourse
is nonconsensual and it is a crime even though you had sex
with the same person previously. It is difficult to determine
if an acquaintance rape has occurred since the couple may
have different perspectives about what happened. In some cases,
the man knows he will not be held accountable and manipulates
the situation causing the women to doubt herself and believe
that she had asked for it. It is important to understand that
sex must be mutual agreement and very step of the phrase of
intimacy consent should be asked.
Sadly the old myth "no means
yes" contributes for a regular man to force himself on
a woman. Another factor is during the cause of intimacy there
is a lack of verbal communication and in some case, intoxication
with alcohol or drug where unconscious state of mind of the
victim is presence.
